    No, a family member cannot claim adverse possession as the element of hostility is absent in such cases.
    If the owner is a minor, mentally unwell, or serves in the armed forces, then the doctrine of adverse possession is considered to be redundant.
    A tenant cannot claim the adverse possession of a property when there has been a lease or rental agreement between the landlord and tenant. However, when the agreement has expired or has been revoked by the landlord, the tenant is expected to vacate the property within a stipulated time period as stated in the agreement. If they still keep on possessing that property despite the knowledge of the landlord, they can claim adverse possession after 12 years.
    To claim an adverse possession, the possession should be for a period of 12 years and it should be of an immovable property. Such a possession should be:

    • An actual possession
    • A hostile possession
    • Peaceful and notorious possession
    • Continuous and uninterrupted possession
    • Exclusive and open possession
    • Possession for a period of 12 years
    Adverse possession of agricultural land and other types of properties is governed by the Limitation Act, 1963.
